About these terms

These Terms & Conditions ("Terms") apply to every order placed with Temper & Stone ("we", "us", "our") through our website temperandstone.com or any other authorised channel. By placing an order, you agree to these Terms. If anything is unclear, please contact us at howdy@temperandstone.com before ordering.

These Terms operate alongside, and do not exclude or limit, your rights under the Australian Consumer Law (ACL) and equivalent legislation in your country. Where any provision in these Terms conflicts with a non-excludable consumer guarantee under the ACL, the ACL prevails.

Our products

Temper & Stone offers three categories of footwear:

  • In-stock items — finished goods ready for dispatch.
  • Made-to-order items — produced specifically for you from one of our standard designs, after your order is placed.
  • Custom and bespoke items — designed and made specifically for you, based on your individual specifications, measurements, and approved artwork.

Different terms apply to each category, particularly regarding cancellations, changes, and returns. These are detailed below.

Pricing & payment

All prices on our website include any applicable taxes, duties, and shipping for your destination — the price you see at checkout is the price you pay, with no surprise charges on delivery.

Prices are listed in AUD unless otherwise specified. We reserve the right to update pricing at any time, but changes will not affect orders that have already been placed and confirmed.

Payment terms by product type:

  • In-stock items: full payment at checkout. Items are dispatched once payment is confirmed.
  • Made-to-order items: full payment at checkout. Production begins once payment is confirmed.
  • Custom and bespoke items: a non-refundable design deposit at consultation booking, with the balance invoiced and paid before production begins. Specific deposit amounts and terms are confirmed during your consultation.
  • Buy-now-pay-later (BNPL): orders placed via BNPL providers (such as Afterpay, Klarna, or PayPal Pay in 4) are processed immediately on confirmation. Any disputes regarding BNPL repayment terms are between you and the BNPL provider.

Made-to-order and custom orders

Made-to-order, custom, and bespoke items are produced specifically for you based on the design specifications, measurements, and approved artwork you provide.

Before submitting your order, please carefully review:

  • Your size selection, with reference to our size guide and any sizing recommendations specific to the style
  • All measurements you have provided (including foot, ankle, and calf where applicable)
  • All design choices, including leather selection, colour, hardware, and finishings
  • Delivery address and contact details

If you are uncertain about any aspect of your order, please contact us at howdy@temperandstone.com before submitting. Once production has commenced on a made-to-order or custom item, we are not able to accept changes, cancellations, or returns based on incorrect specifications, measurements, or change of mind.

This does not affect your rights under the Australian Consumer Law in the event the item has a manufacturing defect, is faulty, or differs significantly from what was ordered (see Warranty and Returns and your consumer rights below).

Group and event orders

For group orders (such as bridal parties or event groups), we strongly recommend placing all orders together as a single transaction. This allows us to source the natural materials from a single batch and minimise visual variation between pairs.

Leather and other natural materials inherently vary in grain, tone, and finish. While we make every effort to match across a group order, some variation is normal and is not a defect. Group orders placed separately, or at different times, may result in greater colour and texture differences.

Production and dispatch

Lead times are estimates based on current workshop capacity and supply chain conditions:

  • Made-to-order: up to 8 weeks from the date your order is placed.
  • Custom and bespoke: up to 12 weeks from the date you approve the final design.
  • In-stock: typically dispatched within 2–5 business days of payment confirmation.

Where an order contains items from multiple categories, items may be dispatched separately as they become ready.

Estimated delivery times do not include factors outside our control, including but not limited to international customs processing, third-party courier delays, weather events, natural disasters, industrial action, or other force majeure events.

Rush production

We do not generally offer rush production. In exceptional circumstances we may agree to expedite an order at our discretion, subject to additional fees. Where rush production is agreed, the indicated delivery time is a best-effort estimate, not a guarantee.

Shipping, customs, duties, and taxes

For all orders — Australian and international — the full landed cost (including any applicable shipping, GST, VAT, customs duties, and import taxes) is calculated and charged at checkout based on your delivery address.

We collect any international duties and taxes upfront and remit them to the relevant authorities, so your order clears customs without additional charges due on delivery.

If a parcel is refused, returned, or undeliverable due to incorrect address details, refused customs clearance, or unclaimed delivery, we reserve the right to deduct return shipping and any reasonable handling costs from any refund issued.

Cancellations and changes

In-stock items: as in-stock orders are processed and dispatched promptly, we generally cannot make changes after an order is placed. Please contact us immediately at howdy@temperandstone.com if you need to amend or cancel an order, and we will assist where possible.

Made-to-order items: changes or cancellations are possible only before production has commenced. Once production has commenced, we are not able to accept cancellations, refunds, or changes based on change of mind, sizing decisions, or design preferences.

Custom and bespoke items: the design deposit becomes non-refundable once design work has begun (typically immediately following consultation). Once you approve the final artwork and the balance is invoiced and paid, production commences and the order cannot be cancelled.

Warranty

Every pair of Temper & Stone boots is covered by a 12-month manufacturer's warranty against defects in materials and workmanship, beginning from the date of delivery. This warranty applies in addition to your rights under the Australian Consumer Law and does not limit those rights.

What's covered:

  • Defects in stitching that compromise the structural integrity of the boot
  • Failure or separation of the Goodyear welt
  • Sole bonding failure (where the sole detaches from the welt other than through normal wear)
  • Tears or splits in the leather lining not caused by wear or misuse
  • Hardware failure including eyelets, hooks, zippers, and buckles
  • Manufacturing faults that materially affect the wearability or appearance of the boot

What's not covered:

  • Normal wear and tear, including sole wear, heel wear, and general use marks
  • Scuffs, scrapes, surface marks, and patina that develops with wear
  • Stretching, creasing, and softening of leather over time, which are characteristics of natural materials
  • Water, salt, mud, or weather damage, including from prolonged exposure to wet conditions
  • Damage caused by misuse, including wearing the boots in conditions or for activities they were not designed for
  • Damage caused by improper care, including failure to condition the leather, exposure to direct heat, or use of harsh cleaning products
  • Damage caused by repairs, alterations, or modifications performed by anyone other than Temper & Stone or our authorised repair partners
  • Damage caused by accidents, including dropping, crushing, or impact
  • Loss or theft
  • Cosmetic differences inherent to natural leather (variation in grain, tone, marking)
  • Issues arising from incorrect sizing, fit decisions, or measurements provided at the time of order

Beyond the 12-month warranty period:

Australian Consumer Law guarantees may continue to apply for a reasonable period beyond the 12-month warranty, depending on the nature of the goods and the defect. Major manufacturing defects that emerge after the warranty period will be assessed on a case-by-case basis. Our Goodyear-welt construction is also designed to be repairable, and many issues that emerge through normal wear can be addressed through resoling or repair — contact us at howdy@temperandstone.com for guidance.

Returns and your consumer rights

Our policy reflects, and does not limit, your rights under the Australian Consumer Law and equivalent consumer protection legislation in your country.

What we don't accept returns or refunds for:

  • Change of mind
  • Sizing or fit decisions made at the time of order
  • Selecting the wrong size, providing incorrect measurements, or supplying inaccurate specifications
  • Shipping or production timing within the estimates given at the time of order
  • Natural variation in leather and other materials
  • Items excluded from our warranty (see Warranty above)

Your rights under the Australian Consumer Law:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

A "major failure" includes where the goods:

  • Have a problem that would have stopped someone from buying them if they had known about it
  • Are unsafe
  • Are significantly different from the sample or description
  • Don't do what we said they would, or what you asked for, and can't easily be fixed

For non-major failures, we will repair the goods within a reasonable time. If they cannot be repaired within a reasonable time, you may choose a refund or replacement.

How to make a claim:

If you believe your boots have a fault, defect, or do not match what was ordered, please contact us at howdy@temperandstone.com with:

  • Your order number
  • Photographs clearly showing the issue
  • A brief description of the fault
  • Your proof of purchase

We will assess your claim and respond within 5 business days. We may request the goods be returned to us for inspection. Where a claim is approved, we will arrange repair, replacement, or refund as appropriate to the circumstances.

We reserve the right to assess the condition and age of returned goods before providing a remedy. Where damage is the result of normal wear and tear, misuse, or modifications made after delivery, a remedy may not be available.

Natural materials

Our boots are made from natural leathers, which inherently vary in grain, tone, marking, and finish. Some variation between pairs, and between samples and finished items, is a normal characteristic of natural materials and is not considered a defect.

Intellectual property

All artwork, designs, photographs, written content, and branding on our website and in our communications are the intellectual property of Temper & Stone or used under licence. They may not be reproduced, distributed, or used commercially without our written permission.

For custom orders, you confirm by submitting a design that you have the right to do so and that the design does not infringe on any third party's copyright, trademark, or registered design rights. We undertake reasonable due diligence on custom designs before production but rely on you to provide accurate information.

Disputes and chargebacks

If you have an issue with your order, please contact us first at howdy@temperandstone.com. We are committed to resolving legitimate concerns quickly and fairly.

Initiating a credit card chargeback or payment dispute without first attempting to resolve the issue with us directly may be considered a breach of these Terms. We retain detailed records of every order, including communications, design approvals, dispatch, and proof of delivery, and will defend disputes that have not first been raised with us.

Privacy

Personal information you provide is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Where we request identification or additional personal information to process a return claim, this information is used solely for that purpose and managed in accordance with our Privacy Policy.

Limitation of liability

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Australian Consumer Law or any other applicable legislation that cannot be lawfully excluded.

To the extent permitted by law, our liability for any failure of our goods is limited to one or more of: replacement of the goods, repair of the goods, or refund of the purchase price.

Governing law

These Terms are governed by the laws of Victoria, Australia. Any dispute arising under or in connection with these Terms is subject to the non-exclusive jurisdiction of the courts of Victoria.

Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the version published on our website at the time you placed the order. We will display the most recent update date at the top of this page.
